Workplace privacy law

State-by-state workplace electronic monitoring laws.

Workplace electronic monitoring law varies materially by state. New York, Connecticut, and Delaware require employee notice or acknowledgment. California, Illinois, and Washington layer on biometric or comprehensive privacy regimes. Most other states default to the federal floor under the Electronic Communications Privacy Act. This index covers all 50 states plus the District of Columbia, with the operative statute citation for each.
